Licence agreement — Data Clinic Recovery for Hard Drives
End-user licence agreement for Data Clinic Recovery for Hard Drives
- Who you’re dealing with. The software is sold through Onelink, the merchant-of-record service of Stripe, which resells it on our behalf and handles payment, VAT, receipts and refunds. The software is owned by Private Key Ltd and licensed to Data Clinic Ltd, which grants your licence under this agreement and provides support. “We” below means Data Clinic Ltd.
- What you get. A licence to install and use the software on the terms of the licence type you bought: Personal (one person, their own drives, one PC at a time) or Business (one business, up to three PCs, for use on customers’ drives). Personal licences are not for commercial use.
- Duration. 28 days or one year from the date of issue, as bought. Yearly licences renew unless cancelled; see the refund policy.
- What the software does and does not promise. The software reads drives and recovers what can be read. It cannot recover overwritten data, TRIM-erased data on SSDs, or encrypted data without its key, and it will refuse to scan a drive whose health report shows it is failing. Verdicts shown in the software are its honest assessment at scan time, not a guarantee that a file will open. The refund policy sets out what we do when recovery falls short.
- Read-only, by design. The software never writes to, repairs or formats the drive it scans. Recovered files are written only to a drive you choose, which cannot be the source drive.
- What you may not do. Resell, sublicense or share the licence key beyond the seats allowed; use a Personal licence commercially; remove or alter the software’s copyright, licence or honesty notices; reverse-engineer the software except where the law allows.
- Data. The software sends nothing over the internet unless you choose to — a problem report (Help menu) or a lab contact request (failure screen), both of which tell you what they include and send nothing until you press Send — except two automatic checks: when the software starts with a licence key and the computer is online, it sends the key and the program’s version to Data Clinic to find out whether it has been renewed or refunded; and when it starts and the computer is online, it also asks dataclinic.co.uk whether a newer version is available — that request contains nothing about you or your drives. It never sends the contents of your files. A problem report includes the program’s technical log, which can name drives, volumes and a file you viewed; a contact request includes the drive’s model, size and symptoms. See our privacy policy.
- Liability. Nothing in this agreement limits liability that cannot be limited by law. Otherwise, our liability for loss arising from the software is limited to the price you paid for the licence. Data recovery is uncertain by nature; keep the original drive and do not rely on any single recovery attempt for irreplaceable data.
- Law. England and Wales.
